What happens if I don't reply to the Registrar's objections in time?

The Registrar may raise objections to your trade mark application for a number of reasons. For example, your entire trade mark application may be objected to if the mark is deemed to be not capable of distinguishing your goods/services from other traders. Another example is where some of the goods/services may be objected to if they are considered to be filed in the wrong class or the description of the goods/services is unclear.


If you do not reply to the Registrar's objections in time, the entire trade mark application or the objected goods/services will be regarded as "Treated as Withdrawn (Continued Processing Possible)".


When this happens, you will have another two months to file Form CM13 (via IPOS Digital Hub) to request for the continued processing of the trade mark application or the objected goods/services. Your request for continued processing must be accompanied by a response to IPOS' examination report.


If no request for continued processing is filed in time and your application is filed before 26 May 2022, your entire application will become treated as withdrawn and can no longer proceed to registration.


If no request for continued processing is filed in time and your application is filed on or after 26 May 2022 AND:

(a) All of the claimed goods/services in your application are being objected to, your entire application will become treated as withdrawn and can no longer proceed to registration.

(b) Some of the claimed goods/services in your application are being objected to, only the objected goods/services will be treated as withdrawn and can no longer proceed to registration. The remaining non-objectionable goods/services in the application will proceed to the next processing stage.
